1. ACCEPTANCE OF THESE TERMS
These Terms and Conditions apply to your use of this website and any advertising-management, creative-design or related digital-marketing service provided by Kazi Agency.
By requesting a quotation, confirming a service through WhatsApp or instructing us to begin work, you agree to these Terms and Conditions. If you do not agree with these terms, you should not purchase or use our services.
2. PURPOSE OF THIS WEBSITE
The information displayed on this website provides a general introduction to our services. Website content, package names, price ranges and estimated durations are provided for general guidance and do not constitute a final or binding offer.
The exact service, price, advertising budget, number of creatives, campaign duration, target location, platforms, deliverables and working schedule will be confirmed in writing through WhatsApp or another agreed communication channel before work begins.
No service, price, deadline or result will be considered confirmed until both parties have accepted the final details in writing.
3. SERVICE SCOPE
Depending on the package and written agreement, our services may include:
• Advertising strategy and planning
• Facebook and Instagram campaign setup
• Campaign management and monitoring
• Audience research and targeting recommendations
• Advertising-copy preparation
• Creative image or video preparation
• WhatsApp-focused campaign setup
• Meta Pixel or website-event configuration
• Campaign-performance updates
• Landing-page recommendations
Only services specifically included in the written agreement will be provided. Any additional work, revision, campaign, creative, language, platform or service requested later may require additional payment and additional working time.
4. PRICES, SERVICE FEES AND ADVERTISING BUDGET
Prices shown on this website may be displayed as ranges because the final price depends on the campaign duration, number of advertisements, creative requirements, target market, advertising objective, account condition and amount of work required.
Before payment, we will clearly confirm:
• Our service or management fee
• The Meta advertising budget
• Whether advertising spend is included or excluded
• Campaign duration
• Number of creatives and revisions
• Payment schedule
• Cancellation or refund conditions
• Any additional expected cost
The advertising budget paid to Meta is separate from our service fee unless the written agreement clearly states otherwise.
Meta controls its own advertising charges, billing thresholds, taxes, currency conversion, refunds and payment decisions. We are not responsible for unexpected charges caused by the client’s existing Meta billing settings, outstanding balances, taxes, currency conversion or activity outside the campaigns managed by us.
This website does not directly process online payments. Payment instructions and applicable cancellation or refund conditions will be provided and agreed in writing before payment is made.
Advertising spend that has already been charged or used by Meta may not be refundable. Any Meta advertising refund remains subject to Meta’s own payment and refund decisions.
5. META APPROVAL AND THIRD-PARTY PLATFORMS
Facebook, Instagram, WhatsApp and Meta are third-party platforms operated by Meta. Kazi Agency is an independent advertising-service provider and is not affiliated with, sponsored by or officially endorsed by Meta.
Meta independently controls:
• Advertisement review and approval
• Advertisement delivery
• Advertising costs and auctions
• Account verification
• Spending limits
• Payment restrictions
• Page, Business Portfolio and advertising-account restrictions
• Pixel and event-data processing
• Policy interpretation and enforcement
• Suspension or removal of advertisements and business assets
We cannot override or control Meta’s systems or decisions. Approval of a previous advertisement does not guarantee that the same or a similar advertisement will be approved again.
Meta may change its policies, features, targeting options, reporting systems or advertising tools at any time without notice to us.
6. NO GUARANTEE OF ADVERTISING RESULTS
We will make reasonable professional efforts to prepare and manage campaigns responsibly. However, we do not guarantee:
• Advertisement approval
• A specific number of messages, leads or sales
• A particular cost per result
• A specific reach, impression or click level
• Increased revenue or profit
• Continuous advertisement delivery
• Recovery of a restricted advertising account
• First-page ranking or any other platform position
• Any particular business outcome
Advertising performance can be affected by competition, market demand, advertising budget, target location, offer quality, service quality, pricing, reputation, creative quality, seasonality, account history, customer response time and Meta’s delivery system.
Performance examples, estimates or previous campaign results are provided for informational purposes only and do not guarantee future performance.
7. CLIENT RESPONSIBILITIES
The client must provide accurate, complete, current and lawful information about the business, service, price, location and offer being advertised.
The client is responsible for:
• Confirming that the advertised business and service are legal
• Providing accurate prices, offers and service details
• Supplying necessary licences, permits or authorisations
• Having the right to use all submitted images, videos, logos and text
• Providing access only to legitimate business assets
• Maintaining a valid payment method for Meta advertising charges
• Responding to customer enquiries responsibly
• Delivering the advertised service as represented
• Informing us immediately about changes to the offer or business
• Reviewing and approving advertisements before publication when requested
The client must not provide false testimonials, fake reviews, misleading before-and-after images, stolen content, unauthorised logos or unverified claims.
The client must disclose if an advertisement concerns housing, employment, financial products, credit, social issues, elections, politics or another regulated or restricted category.
8. META ADVERTISING POLICY COMPLIANCE
We will make reasonable efforts to prepare campaigns according to the Meta Advertising Standards applicable at the time of preparation. However, we do not provide a legal guarantee that Meta will approve an advertisement or consider every element compliant.
Advertisements, landing pages and WhatsApp communications must not:
• Promote illegal, prohibited or restricted products without required permission
• Use deceptive, fraudulent or misleading offers
• Hide important prices, charges, conditions or limitations
• Make false or guaranteed-result claims
• Use fake identities, pages, reviews or business information
• Discriminate unlawfully against individuals or groups
• Assert or imply sensitive personal attributes about the viewer
• Use shocking, sexually explicit or unnecessarily disturbing content
• Infringe copyrights, trademarks or other intellectual-property rights
• Collect or request prohibited financial or sensitive information
• Send sensitive personal data through Meta Pixel or other Business Tools
• Serve different content to Meta reviewers and ordinary visitors
• Use cloaking, misleading redirects or methods intended to bypass advertisement review
• Encourage behaviour that violates Meta’s Community Standards or Advertising Standards
We may refuse, pause or terminate work if we reasonably believe a campaign, business, product, landing page or instruction may violate Meta policy, applicable law or the rights of another person.
9. PERSONAL ATTRIBUTES AND DISCRIMINATION
Advertising copy must not state or imply that we know a viewer’s sensitive personal characteristics.
This may include race, ethnicity, religion, disability, medical condition, financial status, sexual orientation, criminal history or other protected or private characteristics.
Audience targeting must not be used to unlawfully exclude, discriminate against or disadvantage protected groups.
The client must provide accurate information if a campaign requires Meta’s Special Ad Category or any other restricted targeting method.
10. META PIXEL AND BUSINESS TOOL DATA
If Meta Pixel or another Meta Business Tool is used, it must be implemented according to Meta’s Business Tools Terms and applicable privacy requirements.
We will not intentionally configure Pixel events to send:
• WhatsApp message contents
• Unhashed customer names, telephone numbers or email addresses
• Passwords or payment information
• Health or medical information
• Financial-account information
• Information from or about children under 13
• Other prohibited or sensitive personal information
The website’s Privacy Policy and consent controls explain how optional Pixel tracking is used. Visitors must be given any notice, choice or consent required by applicable law.
The client must not ask us to use Meta Pixel, Conversions API, Custom Audiences or another advertising tool in a way that unlawfully collects, shares or targets personal information.
11. CREATIVE CONTENT AND INTELLECTUAL PROPERTY
The client confirms that they own or have permission to use all images, videos, logos, testimonials, trademarks, music and other materials supplied to us.
Unless otherwise agreed in writing, the client grants us permission to use the supplied materials only as necessary to prepare and manage the agreed advertising service.
We are not responsible for copyright, trademark, privacy or licensing claims arising from materials supplied or approved by the client.
Any stock, licensed or third-party content remains subject to its original licence conditions.
The client must not describe sample, stock or AI-assisted images as photographs of completed work if doing so would mislead customers.
12. APPROVALS, COMMUNICATION AND WHATSAPP
WhatsApp may be used to confirm service details, prices, advertising budgets, creative approvals, changes and working instructions.
The client is responsible for reviewing advertisements, prices, telephone numbers, WhatsApp links, spelling, claims and service information before approving publication.
Once the client approves an advertisement or creative, we are not responsible for an error that was visible and reasonably identifiable during the approval process.
Delays in receiving information, access, payment or approval from the client may extend the campaign or delivery schedule.
13. ACCOUNT ACCESS AND SECURITY
The client should provide only the access required to complete the agreed service. Passwords should not be shared when Meta Business Portfolio access, Page access or advertising-account access can be granted securely.
The client remains responsible for the security of their Facebook account, Instagram account, WhatsApp account, email account, Business Portfolio, advertising account and payment method.
We are not responsible for restrictions, loss or unauthorised activity caused by compromised credentials, previous violations, unknown administrators, malware or actions taken outside our control.
14. SUSPENSION, CANCELLATION AND TERMINATION
Either party may request cancellation according to the written agreement confirmed before work begins.
We may immediately refuse, pause or terminate a service if:
• The client provides false or misleading information
• The requested campaign may violate law or Meta policy
• Required payment is not made
• Necessary account access is removed
• The client requests prohibited targeting or content
• The client uses our work for fraudulent or unlawful activity
• Continuing the service may place our business or advertising assets at risk
Any payment, refund, unused budget, completed work or outstanding balance will be handled according to the written agreement and applicable law.
15. LIMITATION OF RESPONSIBILITY
To the extent permitted by applicable law, we are not responsible for indirect loss, lost profit, lost business opportunity or reputational damage caused by advertising performance, Meta decisions, platform outages, account restrictions or actions outside our reasonable control.
We are not responsible for a client’s service quality, customer disputes, failure to fulfil an offer, unlawful business activity or inaccurate information supplied by the client.
Nothing in these terms excludes responsibility that cannot legally be excluded under applicable law.
16. PRIVACY
Use of this website and any optional Meta Pixel tracking is also governed by our Privacy Policy.
When a visitor clicks a WhatsApp button, the communication continues through WhatsApp and becomes subject to WhatsApp’s own terms and privacy practices.
17. CHANGES TO THESE TERMS
We may update these Terms and Conditions when our services, pricing methods, website features, third-party platforms or legal obligations change.
The latest version and its update date will be published on this website. Changes will not alter an already confirmed service agreement unless both parties agree or the change is required by law or platform policy.
18. GOVERNING LAW AND DISPUTES
These Terms and Conditions are governed by the applicable laws of Bangladesh unless another jurisdiction is required by law or agreed in writing.
Both parties should first attempt to resolve any complaint or disagreement through good-faith written communication.
